Neosensory Inc. (“Neosensory”) warrants to the original purchaser that the hardware product shall be free from defects in material and workmanship for a period of one (1) year from the date of purchase, except that if you reside in the European Economic Area and you purchased Buzz in the European Economic Area, the warranty period is two (2) years from the date of purchase. If a defect covered by this warranty occurs during this warranty period, Neosensory will repair or replace the defective hardware product or component, free of charge.* The original purchaser is entitled to this warranty only if the date of purchase is registered at point of sale or the consumer can demonstrate, to Neosensory’s satisfaction, that the product was purchased new within the applicable warranty period.

(INCLUDING, BUT NOT LIMITED TO, NON-LICENSED ADAPTERS, SOFTWARE, AND POWER SUPPLIES); (b) IS MODIFIED OR TAMPERED WITH; (c) IS DAMAGED BY NEGLIGENCE, ACCIDENT, UNREASONABLE USE, OR BY OTHER CAUSES UNRELATED TO DEFECTIVE MATERIALS OR WORKMANSHIP; OR (d) HAS HAD THE SERIAL NUMBER ALTERED, DEFACED OR REMOVED.

IN NO EVENT SHALL NEOSENSORY BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, REGARDLESS OF THE FORM OR THE ACTION OR THE THEORY OF RECOVERY, EVEN IF NEOSENSORY HAS BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES, AND LIMITS LIABILITY TO REPLACEMENT, REPAIR OR REFUND OF THE PURCHASE PRICE PAID FOR THE PRODUCT, AT NEOSENSORY’S OPTION. THIS DISCLAIMER OF LIABILITY FOR DAMAGES WILL NOT BE AFFECTED IF ANY REMEDY PROVIDED HEREIN SHALL FAIL OF ITS ESSENTIAL PURPOSE.
